PRIVACY POLICY
DATA PROTECTION (Organic Law 15/1999 of 13th December)
In compliance with Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of their Personal Data and the free circulation of such data (hereinafter GDPR) we inform you that,
CB Germans Sesplugues with CIF E66571019 and registered office in Consell de Cent 366, 1-1, 08009, Barcelona, Spain is responsible for the processing of the data requested through the booking form, hereinafter the "Data Controller" or "HoHomes".
1. PURPOSE OF TREATMENT
The purpose of processing is to maintain a commercial relationship with the User. Of the data requested to complete a reservation, those fields marked with an asterisk (name, surname, mail, telephone) are essential for processing the booking, queries or any type of request by the user through any of the available contact methods. Additionally, the data of any traveller being lodged at the property is also necessary to fill in the traveller entry form required by Spanish authorities in accordance of Law 04/2013. It is possible that the Data Controller will be conducting internal statistical studies and sending commercial advertising communications, like for example a website Newsletter or Special Offers to recurring HoHomes customers by email, fax, SMS, MMS, social communities or by any other electronic or physical means, present or future, that make it possible to carry out such commercial communications. These communications will be exclusively made by HoHomes and will be related only to its products and services, although may be advertised in combination with the products and services of the service suppliers with whom HoHomes has reached a promotional agreement (please see our advertised services at this page). In this last case, these third parties (service suppliers) will never be given or have access to your personal data, nor the communications will never be made by any party other than HoHomes, nor related to any commercial purposes outside of the enhancement of your own experience with HoHomes.
2. TREATMENT
The personal data provided through the booking form is treated confidentially and incorporated into a treatment file identified as “Clients” in order to keep a record of reservation requests received through our website and be able to manage them. Also the data provided in the traveler entry form upon check-in will be shared with the local police authorities in compliance of the Spanish Law 04/2013.
3. RETENTION CRITERIA AND EXERCISE OF RIGHTS
The legitimacy of this treatment is based on the consent of the interested party, the data will not be communicated to third parties unless the Client has requested a booking of a service provided by a partnered third party, under which scenario will be also subject to the third party's data protection policy. The data will be kept for the time necessary to fulfill the stated purpose and while there is a mutual interest in maintaining the purpose of processing. When such purpose is no longer necessary or of interest to one or both parties, the data will be erased with the appropriate security measures to ensure the pseudonymisation or the complete destruction of the data. CB Germans Sesplugues will proceed to its deletion if the interested party exercises his/her right of withdrawal, which –like the rest of the rights– can be asserted by sending an email to info@hohomes.es, attaching a copy of his ID and indicating in the subject “data protection: [right to be asserted]”. The following rights can be asserted: right of access, rectification, portability and erasure of the client's data and the restriction or opposition to their processing. Right to file a complaint with the supervisory authority (agpd.es) if he/she considers that the processing does not comply with current legislation.

4. ACCEPTANCE
The Users, by marking the corresponding boxes and entering data in the fields, marked with an asterisk
(*) in the contact, booking, or download forms, accept expressly and in a free and unequivocal way that their data is necessary for the supplier to meet their request, voluntarily providing their data in the remaining fields. The User ensures that the personal data provided to the Data Controller is true and is responsible for communicating any changes to them.
5. SECURITY MEASURES
In accordance with the provisions of the current regulations on the protection of personal data, the Data Controller hereby declares that is complying with all the provisions of the GDPR regulations for processing the personal data for which he/she is responsible, and is manifestly complying with the principles described in Article 5 of the GDPR, by which they are processed in a lawful, fair and transparent manner in relation to the data subject and appropriate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
The Data Controller guarantees that all appropriate technical and organisational policies have been implemented to apply the security measures established by the GDPR in order to protect the rights and freedoms of Users, and has communicated the appropriate information for them to be able to exercise their freedoms and rights.
